Free choice of funeral director: a right of every family

No one can impose a funeral director.

In Belgium, every family has the right to freely choose a funeral director. No care institution, nursing home, hospital, insurance company, or other organization may impose a specific funeral director. Naturally, they can provide information or offer a list of companies, but the final choice belongs exclusively to the next of kin.

It is therefore important to know that you are never obliged to accept a proposal from third parties. You may contact the funeral director you trust and who best aligns with your wishes and expectations.

Respect for the wishes of the deceased

Sometimes, a person has already clearly indicated during their lifetime which funeral director they wish to use. This may have been discussed verbally with the family or recorded in writing. In that case, it is naturally important to respect that wish to the fullest.

After all, a funeral is a personal farewell. That is precisely why the choice of funeral director must align with the values, beliefs, and expectations of the deceased and their loved ones.

The exception: Public Social Welfare Centre funerals

There is one important exception to the free choice. When it concerns a funeral organized by the Public Centre for Social Welfare (OCMW) because no financial resources are available, the OCMW usually works with a pre-assigned contract.

These assignments are assigned to a single funeral director for a specific period via a public tender or government contract. However, this does not mean that this contract is permanently awarded to the same company.

On the contrary, Public Centres for Social Welfare (OCMWs) regularly reissue these tenders. Any funeral director who meets the conditions and wishes to participate is given the opportunity to apply. In this way, fair and transparent competition is guaranteed, and every entrepreneur is given an equal chance to secure the contract.

A choice based on trust

The relationship between a family and a funeral director is based on trust. During an emotionally difficult time, it is important that you feel heard, that your wishes are taken into account, and that the farewell is organized in a respectful manner.

Therefore, always take the time to make a conscious choice. Get informed, ask questions, and above all, choose the funeral director with whom you feel comfortable. Ultimately, it is about a farewell that does justice to the life of your loved one.
